1. Introduction and Acceptance

Welcome to Solace Bend. These Terms and Conditions govern your use of our website and your relationship with us when inquiring about or utilizing our residential living services.

By accessing our website or contacting us about our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.

These terms apply to all visitors, prospective residents, residents, and their families or representatives.

2. Definitions

For the purposes of these Terms and Conditions:

  • "We," "Us," "Our" refers to Solace Bend, a residential living facility located in Pattaya, Thailand.
  • "You," "Your" refers to the person accessing our website or using our services.
  • "Services" means the residential living accommodations, meals, activities, and support provided by Solace Bend.
  • "Website" refers to our online presence at solacebes.pro.
  • "Resident" means an individual who has entered into a residence agreement with Solace Bend.
  • "Agreement" refers to these Terms and Conditions and any additional residence agreement entered into between a resident and Solace Bend.

3. Eligibility and Capacity

To inquire about or enter into a residence agreement with Solace Bend, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and truthful information in all communications and applications

If you are making an inquiry or arrangement on behalf of another person, you represent that you have the legal authority to do so.

4. Services Description

Solace Bend provides residential living services for seniors, including:

  • Accommodation in one of three residence types: Shared Living, Courtyard Residence, or Independent Suite
  • Three daily meals prepared on-site
  • Housekeeping and laundry services
  • Organized activities and social programs
  • Daily support and check-ins from staff
  • Access to common areas and amenities

Specific services vary by residence type as described on our website and in individual residence agreements.

Please Note: Solace Bend does not provide medical or nursing care. Our services are designed for individuals who can manage their daily personal care independently or with minimal assistance.

5. Application and Admission Process

The process for becoming a resident includes:

  • Initial Inquiry: Contact us via website, phone, or in-person visit
  • Facility Tour: Visit Solace Bend to view accommodations and meet staff
  • Assessment: Discussion of your needs, preferences, and health status to determine suitability
  • Documentation: Completion of application forms and provision of required information
  • Agreement: Review and signing of residence agreement and fee schedule
  • Move-in: Coordination of move-in date and settling into your residence

We reserve the right to decline an application if we determine our services cannot adequately meet an applicant's needs or if accommodations are not available.

6. Fees and Payment Terms

Monthly Fees:

  • Shared Living Residence: ฿6,800 per month
  • Courtyard Residence: ฿17,500 per month
  • Independent Suite with Support: ฿40,000 per month

Payment Terms:

  • Monthly fees are due on the first day of each month
  • Payment accepted in Thai Baht via bank transfer or cash
  • A deposit equivalent to one month's fee is required upon move-in
  • Late payments may incur additional charges as specified in the residence agreement

What's Included: Monthly fees cover accommodation, three daily meals, housekeeping, laundry, organized activities, and daily support services as outlined for each residence type.

Additional Costs: Personal items, special dietary requests beyond standard meal planning, individual transportation, and personal care products are not included in monthly fees.

Fees are subject to change with 60 days' written notice to residents.

7. Resident Responsibilities

As a resident or prospective resident, you agree to:

  • Provide accurate health and personal information
  • Pay all fees on time according to the agreed schedule
  • Treat staff, other residents, and visitors with respect
  • Follow facility policies and house rules
  • Maintain your living space in reasonable condition
  • Inform staff of changes in health status or needs
  • Respect the privacy and personal space of other residents
  • Participate in orientation and safety briefings

Violation of these responsibilities may result in termination of residence in accordance with the residence agreement.

8. Our Responsibilities

Solace Bend commits to:

  • Provide clean, safe, and well-maintained accommodations
  • Prepare and serve three nutritious meals daily
  • Offer organized activities and social programs
  • Maintain appropriate staffing levels for resident support
  • Respect resident privacy and dignity
  • Respond promptly to resident concerns and requests
  • Maintain confidentiality of resident information
  • Provide clear communication about services, fees, and policies

9. Termination of Residence

By Resident: Residents may terminate their residence agreement with 30 days' written notice. Fees paid for the notice period are non-refundable.

By Solace Bend: We may terminate a residence agreement if:

  • The resident's needs exceed our service capabilities
  • Monthly fees remain unpaid for 30 days after the due date
  • The resident's behavior poses a safety risk to themselves or others
  • There is a material breach of the residence agreement

In most cases, we will provide 30 days' notice of termination unless immediate action is required for safety reasons.

10. Limitation of Liability

To the extent permitted by Thai law:

Solace Bend provides residential living services with reasonable care and skill. However, we are not liable for:

  • Medical conditions or health changes that occur independently of our services
  • Loss or damage to personal property unless caused by our negligence
  • Injuries or accidents that occur outside our reasonable control
  • Delays or service interruptions caused by circumstances beyond our control

Our total liability for any claim related to our services shall not exceed the amount of monthly fees paid by the resident in the 12 months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded by law.

11. Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Solace Bend or our licensors and is protected by Thai and international copyright laws.

You may view and print content from our website for personal, non-commercial use. You may not:

  • Modify, copy, distribute, or reproduce website content without permission
  • Use our name, logo, or branding without written authorization
  • Create derivative works based on our website content

12. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and Thai data protection laws, including the Personal Data Protection Act (PDPA).

13. Disclaimers

Our services are provided on an "as is" basis. While we strive to provide high-quality care and accommodation, we make no warranties or representations that:

  • Services will meet every individual preference or expectation
  • All activities or amenities will be available at all times
  • Residence at Solace Bend will result in specific health or wellness outcomes

Information on our website is for general guidance only and should not be relied upon as professional medical, legal, or financial advice. We recommend consulting appropriate professionals for specific situations.

14. Governing Law and Jurisdiction

These Terms and Conditions and any residence agreements are governed by the laws of Thailand.

Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Chonburi Province, Thailand.

Before pursuing legal action, we encourage residents and their families to contact us directly to resolve concerns through informal discussion or mediation.

15. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time. When we make changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Post the revised terms on our website
  • Notify current residents of significant changes via email or written notice

Continued use of our website or services after changes take effect constitutes acceptance of the revised terms.

16. General Provisions

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

Waiver: Our failure to enforce any right or provision in these terms does not constitute a waiver of that right or provision.

Entire Agreement: These Terms and Conditions, together with our Privacy Policy and any signed residence agreement, constitute the entire agreement between you and Solace Bend.

Assignment: You may not transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to another entity if ownership of Solace Bend changes.
